WARRANTIES AND DISCLAIMERS AND SALES POLICIES
The component(s) and/or
services you have purchased from 1st Stop Performance (hereafter “1st Stop”) are
sold with the following “Limited Warranties and Disclaimers,” and “Sales
Policies.” 1st Stop Import Performance fully strives to provide our customers
with excellent warranty service and cooperation with
responsiveness to inquiries.
This is our service commitment to you.
WARRANTY AND DISCLAIMER
1st Stop Performance warrants
new parts and labor that is supplied to the legally registered owner for a
period of 2 year, 24,000 mile warranty; whichever occurs first, unless stated
otherwise. Our 2 year warranty is over twice as long as most traditional repair
facility’s warranty. Any qualifying warranty, exchange, or returned items or
service are to the original purchaser only. 1st Stop’s warranty on products and
services only equal the stated warranty coverage posted on the final invoice or
the original manufacture, rebuilder, or supplier’s printed warranty; which ever
comes first. In the event no warranty is clear printed on final invoice, the
product or service is sold “as is,” with no warranty coverage whatsoever. No
warranty, neither written, expressed, nor implied will be offered on the
installation of used parts, customer supplied parts, or performance parts. No
Warranty, neither written, expressed, nor implied will be offered on excessively
worn parts due to abuse or neglect. No refund considerations without original
paid invoice, or after 30 days from completion or ship date. No warranty,
refunds, or returns on any electrical parts or any used parts. Prior to any
warranty repairs, the customer must first contact 1st Stop. All qualifying
labor warranties are to be performed by 1st Stop, unless written authorization
is issued at the sole discretion of 1st Stop. It is the customers
responsibility to return all related components to 1st Stop for any qualifying
labor warranty considerations. 1st Stop assumes no responsibility or liability
for damages, injuries, shipping fees, rental fees, and/or any related or
unrelated failure or labor fees. The warranty of this vehicle is subject to the
availability of parts and labor. We are not responsible for the unavailability
of parts or delays in part shipments beyond the repair facilities control.
Purchased performance products or services are intended for use in a high
performance racing or off-road environment and will be subjected to abnormal
stress. Failure of such products or services are to be expected even under
normal use with required maintenance. The activities for which this performance
product or service has been designed are in and of themselves inherently
dangerous. 1st Stop assumes no responsibility or liability for damages or
injuries which may result from the use or installation of any performance
product or service, whether or not properly installed or used.
1st Stop specifically
disclaims any and all representations and warranties of any product with respect
to marketability, fitness for a particular purpose or design.
Misuse, faulty installation or
reliance upon the appearance product for structural integrity or performance
characteristics may result in serious bodily injury. Failure of the appearance
product due to defect in materials or workmanship not resulting from misuse or
reliance on the appearance product for structural integrity or
will entitle the original purchaser, with proof of purchase directly from 1st
Stop, to replacement or repair of the product, at 1st Stop’s sole selection,
upon delivery of the failed product or service with return freight prepaid to
manufacture, where applicable. As unfortunate as it is, a failure can occur,
1st Stop Performance will not
be responsible for any towing expenses, rental car expenses, lodging expenses,
meal expenses, loss of use, loss of earnings, per diem expenses, nor any other
expenses the customer may incur or claims of any nature whatsoever. This
warranty is subject to change without notice at any time.
INFORMATION—If you have
a question regarding the installation or operation of a product or service
purchased from 1st Stop please contact us. Any attempt to modify, change or
alter a product or service prior to, during, or after installation, may void
your warranty. Due to the fragile nature of parts, used, altered, or damaged
parts cannot be returned. 1st Stop does not extend credit. Any past due
amount is subject to a $50 Late Fee, reversal of any discounts, and a 22% APR
interest charge per month. If payment is not received in full after 45 days the
account will be turned over to collection proceedings, unless prior written
arrangements have been made with 1st Stop.
returns must be authorized in advance and accompanied by a 1st Stop Return
Authorization Number. No returns without original receipt. Freight must be
prepaid by customer. Your return must be made within 7 days of the Return
Authorization Number being issued. Returned parts will be subject to a 20%
restocking charge, unless waived by 1st Stop. Refunds will not be issued if
merchandise has been altered, damaged, opened, or used. No refunds allowed on
any incurred expenses or labor. Certain components cannot be returned for
exchange or refund due to their fragile nature and possible customer
mishandling. No returns or refunds on any qualifying electrical parts and
special ordered items, exchange only.

damage/ error claims must be made within 5 business days. If parts are damaged,
save original shipping carton and all packing materials to allow for freight
carrier inspection or the claim cannot be honored.
PERFORMANCE, RACING, CUSTOM, OR MODIFIED PRODUCTS AND SERVICES—Certain
parts and services are for racing vehicles and purposes only, which may never be
used upon a highway.

placing any order please provide all necessary information: i.e., chassis year,
chassis model, engine type, engine year, any modifications, etc. By providing
this information in advance we can serve you most efficiently.
accept Cash, Certified Check, Cashiers Check, Money Order, Personal Check,
Business Check as payment. Personal or Business Checks are subject to an up to
a four week period from the date we deposit the check until the release of any
product or service, thereby allowing for Bank, Federal Reserve, and US Mail
Transit Time. .
are normally sent via Fed-Ex or US Postal Service. We ship to the billing
address only. No Post Office Box Shipments. Please contact us requiring
expedited, truck or air freight shipping.
international orders require pre-payment in full for merchandise and freight.
All customer duties, tariffs, and other fees are the sole responsibility of the
consignee. To eliminate any inconvenience or delay please contact us in advance
to verify current prices and payment methods. If you require a specific method
of transportation, you must make arrangements with your freight forwarder and
provide us with the local contact person’s name, phone number, and address to
ship the part. Please call, write, fax or e-mail us for details.
CANCELLATIONS/REFUSED SHIPMENTS/SPECIAL ORDERS—Order’s
cancelled at the customer’s request are subject to a minimum $20 charge plus
charges equal to the costs incurred by 1st Stop at the time of cancellation.
Shipments returned by a freight carrier as undeliverable, refused, non-payment,
etc. will result in the customer’s account being frozen until all charges due to
1st Stop are paid. Parts that are special order items, parts not normally
stocked by 1st Stop, and parts left with 1st Stop for any reason must be paid
for in full or may require a non-refundable 100% deposit. Any parts left with
1st Stop longer than 10 days become the sole property of 1st Stop and will not
PARTS—Every effort is
made to keep sufficient stock on hand, occasionally demand exceeds our supply.
In these instances, customers have the option of either canceling the
backordered or remaining on the backorder list. The part will ship as it
arrives in stock.
